Terms of Service

Please read these Terms of Service ("Terms") carefully before using APYbot ("the Service", "the Bot"), a Telegram bot accessible at @DeFi_APY_bot and associated web pages at apybot.io.

By using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

APYbot is a Telegram bot that monitors decentralized finance (DeFi) liquidity pool yields across blockchain networks (including Arbitrum, Base, and other supported chains). The Service:

• Tracks APY (Annual Percentage Yield) data and metrics sourced from public aggregators (DeFiLlama) and blockchain RPC endpoints
• Sends automated alerts when APY changes exceed a user-defined threshold
• Displays analytical pool information including TVL (Total Value Locked), APY, impermanent loss risk, and audit scores

The Service is provided as-is for informational and analytical purposes only.

2. Not Financial Advice & Non-Custodial Nature

APYbot does not provide financial, investment, tax, or legal advice. All information displayed by the Service is for informational purposes only and should not be construed as a recommendation to buy, sell, stake, or hold any cryptocurrency or DeFi asset.

APYbot is strictly a non-custodial data aggregation tool. We do not hold, touch, custody, route, or execute transactions with your funds or smart contracts.

DeFi protocols carry significant inherent risks including but not limited to:

• Smart contract vulnerabilities, bugs, and exploits
• Impermanent loss and severe divergence loss
• Liquidity crunches and de-pegging events
• Regulatory intervention or legal ambiguity
• Extreme market price volatility and slippage

You are solely responsible for your own financial decisions. Always conduct your own thorough research (DYOR) before interacting with any decentralized protocol.

3. Service Plans and Payment Methods

Free Plan:

• Watch up to 2 assets simultaneously
• Receive up to 3 automated APY spike alerts per day
• Full access to analytical commands (/top, /help)

Paid Plan ($29/month or $199/year):

• Unlimited watched assets
• Unlimited daily automated alerts
• Real-time audit scores and risk analysis
• Custom alert thresholds via /settings

Payment Processing & Terms

APYbot supports two independent payment methods:

• Telegram Stars: Payments via Telegram Stars are processed directly by Telegram using Apple In-App Purchase (iOS) or Google Play Billing (Android). By paying via Stars, you agree to Telegram's payment terms and applicable app store refund policies.
• On-Chain Cryptocurrency (USDC / USDT): Users may elect to pay directly via blockchain transactions (e.g., USDC/USDT on EVM networks such as Arbitrum/Base or TRON). All cryptocurrency payments are final, non-refundable, and irreversible by the nature of decentralized blockchain ledgers. Users are strictly responsible for verifying the destination wallet address, correct token contract, and network before broadcasting transactions. APYbot assumes zero liability for misdirected funds, incorrect networks, or gas fee fluctuations.

4. Eligibility, Sanctions, and AML Compliance

By accessing or using APYbot, you represent and warrant that:

• You are at least 18 years of age and possess the legal capacity to enter into these Terms.
• You are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to comprehensive sanctions by the United States Office of Foreign Assets Control (OFAC), the European Union, or the United Nations.
• You will not use the Service to facilitate money laundering, terrorist financing, or any illegal financial activities.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or malicious purpose
• Attempt to reverse-engineer, decompile, scrape, or overwhelm the Service's technical infrastructure
• Use automated scripts, bots, or concurrent flood requests to bypass rate limits (standard rate limit: 5 commands per 10 seconds per user)
• Impersonate other users or misrepresent your affiliation with any project or entity
• Attempt to manipulate, forge, or spoof webhook payloads or payment verifications

We reserve the absolute right to suspend, rate-limit, or permanently terminate your access to the Service for violations of these Terms without prior notice.

6. Data Accuracy, Third-Party APIs, and Availability

APY and pool data is aggregated from third-party public APIs (including DeFiLlama and Alchemy webhooks) and is provided without warranty of accuracy, completeness, or real-time timeliness. Market data can be delayed, interrupted, or temporarily inaccurate due to indexer lags or network congestion.

We do not guarantee 100% continuous or uninterrupted availability. The Service may occasionally undergo routine maintenance, infrastructure upgrades, or temporary downtime due to upstream provider outages.

7. Limitation of Liability

To the maximum extent permitted by applicable law, APYbot, its developers, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Financial losses, trading losses, or missed yield opportunities resulting from acting upon APY data or bot alerts
• Losses resulting from third-party DeFi protocol hacks, rug pulls, smart contract failures, or token collapses
• Service downtime, delayed alerts, or temporary data discrepancies
• Any actions taken based on analytical outputs provided by the Bot

Your sole and exclusive remedy for dissatisfaction with the Service is to discontinue use and request account deletion via /delete.

8. Indemnification

You agree to indemnify, defend, and hold harmless the operators of APYbot from any liabilities, claims, damages, losses, or legal expenses (including reasonable attorney fees) arising directly or indirectly from your use of the Service, violation of these Terms, or interaction with third-party smart contracts.

9. Changes to Terms

We reserve the right to update or modify these Terms at any time. Material changes will be announced to active users directly through the Telegram bot interface. Continued use of the Service following any update constitutes formal acceptance of the revised Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with internationally recognized commercial law principles. Any dispute, controversy, or claim arising out of or relating to these Terms shall first be addressed through good-faith informal negotiation via official contact channels. If unresolved within 30 days, the dispute shall be submitted to binding arbitration under standard international commercial arbitration rules.
